These terms apply to firsttuesdaylist.com and the First Tuesday List newsletter ("the service"). By using the service you agree to them.
1. What the service is
First Tuesday List compiles information about properties scheduled for foreclosure auction in Harris County, Texas, from public records and public data sources, and adds our own estimates.
2. Not advice, not verified
The information is compiled from public records and is not verified. It may be incomplete, out of date or wrong. Sales can be postponed or cancelled at any time. Estimates such as loan balance and equity are approximations based on stated assumptions.
We are not a law firm, title company, real estate broker, appraiser or auctioneer, and nothing on the service is legal, financial, tax or investment advice. Do your own title and lien research before bidding, and consult qualified professionals.
3. Acceptable use
You agree not to:
- scrape, bulk-download, copy or resell the service's data or content, except as a paid feature allows;
- use the information to harass, threaten or unlawfully contact homeowners, borrowers or occupants;
- interfere with the service or try to access parts of it you're not authorized to use.
4. Third-party content and links
Maps, Street View and imagery come from third parties such as Google and the Harris County Appraisal District. Links to Zillow, Realtor.com, Redfin and other sites are provided for convenience. We don't control those sites and aren't affiliated with them.
5. Membership and billing
The newsletter and the public list are free. You can unsubscribe at any time. Paid membership ("Member") gives one person access to the member features described on the pricing page while the membership is active.
- Price and billing. Membership is billed in advance, monthly or yearly, at the price shown at checkout, plus any sales tax that applies. Payments are processed by Stripe; we don't see or store your card details.
- Founding price. Founding members keep their founding price for as long as their membership stays active without interruption. If a founding membership ends, a new one is at the regular price.
- Renewal. Membership renews automatically at the end of each billing period until you cancel.
- Cancellation. Cancel anytime from "Manage billing" on your member page. You keep access until the end of the period you paid for. We don't give refunds for partial periods, except where the law requires it.
- Price changes. We may change the regular price with at least 30 days' notice by email; the new price applies from your next renewal after the notice. Founding prices don't change while the membership is active.
- Personal use. Membership is for one person. Don't share your sign-in, and don't forward, publish or resell the member spreadsheet, the Research Brief or member data. We may suspend or end a membership that is shared or misused, with a pro-rated refund of the unused period.
- Changes to the service. We may add, change or remove features. If we stop offering membership, we'll refund the unused part of any prepaid period.
6. Our content
The site's design, text, compilations and estimates belong to First Tuesday List. Underlying public records belong to the public.
7. No warranty
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the fullest extent the law allows, First Tuesday List is not liable for any indirect, incidental, special or consequential damages, or for any loss arising from bidding, buying or not buying a property, or from relying on the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing.
9. Indemnity
You agree to indemnify First Tuesday List against claims arising from your misuse of the service or your breach of these terms.
10. Governing law
These terms are governed by the laws of the State of Texas. Disputes will be resolved in the state or federal courts located in Harris County, Texas.
11. Changes
We may update these terms. The date above shows the latest version. Continuing to use the service means you accept the updated terms.
